By using and/or visiting the SeksTube website (collectively, including all Content and User Submissions available through this website, the "Website"), you agree to these Terms of Service. These terms of service, including the SeksTube Privacy Policy, which is incorporated herein, and any future amendments (collectively, the "Agreement"), constitute a legal agreement between SeksTube ("SeksTube") and you. SeksTube shall determine in its sole discretion what action, if any, shall be taken in the event of any discovered or reported violation of the above-mentioned terms.

If you decide to register with SeksTube, you will receive a password and SeksTube ID. You are responsible for maintaining the confidentiality of the password and ID, and are fully responsible for all activities that occur under your password or ID. SeksTube reserves the right to hold you fully responsible for all activities that occur under your password and ID. Further, you agree to (a) immediately notify SeksTube of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. 14. Indemnification.

You agree to defend, indemnify, and hold harmless SeksTube, its members, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Website; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Website.

15. Choice of Law and Jurisdiction.

Unless expressly stated to the contrary elsewhere within the Website, all legal issues arising from or related to the use of the Website shall be construed in accordance with, and all questions with respect thereto shall be determined by, the laws of the State of California applicable to contracts entered into and wholly to be performed within said state. Any controversy or claim arising out of or relating to this Agreement or any user's use of the Website shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Los Angeles, California, and judgment on the arbitration award may be entered into in any state or federal court in California having jurisdiction thereof.
